Can Somebody Sue You for What You Post on Social Media?

Recently Kevin Price, Host of the nationally syndicated Price of Business Show, interviewed David Dozier who is a leading media authority.

Can you post something on Facebook, Twitter or other social media platform, get sued and pay damages? Yes! When you post on social media, you become a publisher with all the responsibilities of one. The social media platform that carries your posts has very limited liability for what you say. One thing your posts can do is libel another person. That person can sue you for defamation and collect money from you. Libel is a false statement that damages the reputation of the victim. The First Amendment protects free speech, including posts on social media. However, not all posts are protected. Legislators are struggling with how to protect free speech while also protecting people from harm by social media platforms (especially children). Currently, Facebook, Twitter and other platforms are largely unregulated, even though their algorithms can cause harm, especially to children and teens. As a general principle, social media platforms should serve the public interest. Heavy-handed government regulation and monopolistic profit-seeking by private platforms threaten that public interest. He says fake news has become a phenomenon, political campaigns use the tactic to influence voters, and that it’s perplexing that a conspiracy-based group such as QAnon has gained national attention.
